On July 25, 2005, he was in a Cairns, Queensland nightclub filming a Big Brother promotional spot. Deering and a 22-year-old unidentified woman were arrested outside the club and charged with causing public discomfort by engaging in an indecent act in public.
He claimed that he had simply gone outside to pee. However, he was released on A$100 bail and later pleaded guilty to three charges and was fined A$1,000 in September 2005.
