Mr. CJ Davis, Chief of the Memphis Police Department, stated in the media on January 25th that Desmond and the other four officers were responsible for Tyre Nichols’ death. He was arrested and booked into the Shelby County Jail in Memphis on January 26, 2023.

Moreover, he was released in the afternoon after posting a $250,000 bond. The video of the fight between Nichols, Bean, Haley, Martin, Mills, and Smith was released on January 27, 2023.

On February 17, 2023, he pleaded not guilty to second-degree murder, official oppression, aggravated kidnapping while possessing a weapon, aggravated assault – acting in concert, official misconduct through unauthorized exercise of official power, two counts of aggravated kidnapping causing bodily injury, and two counts of official misconduct through failure to perform a duty imposed by law. He is due back in court on May 1, 2023.
